UNDP National Policy on Legal Aid Consultant


Swaziland adopted a new Constitution in 2005, which contains a justiciable bill of rights that seeks to promote and protect basic human rights of citizens. Access to justice; fair hearing and right to legal representation is among the basic human rights expected to be conferred by the state. To increase and ensure access to justice, the state has an obligation to provide legal aid services nationally to benefit the poor and marginalised groups. Swaziland remains one of the few countries in the SADC region that does not have a national or sector policy on legal aid. There is no specific legislation that guides the establishment of a legal aid scheme in Swaziland.
A report on the national feasibility study for the establishment of a legal aid system in Swaziland (2011) has revealed that citizens are not aware or sensitised of  their right to access  justice; there are gender disparities in accessing justice based on a range of economic, social and cultural factors; legal costs are generally unregulated thus unaffordable for the majority of the Swazi population; the capacity of judicial institutions and supporting law enforcement agencies is weak in terms of process, procedure and service delivery in general. Users are generally discouraged and are not afforded efficient and effective legal and judicial remedies. The report also highlights four key factors that impede access to justice including absence of appropriate policy and national legal framework; institutional capacity deficiencies; technical and capacity shortcomings on the part of legal practitioners to effectively deliver quality legal outcomes in particular issues relating to human rights and insufficient resources for a sustainable legal aid scheme in Swaziland.
The need for free legal aid services in Swaziland therefore arises in response to demand from the majority of the poor and people in vulnerable circumstances who need access to justice in various forms. Legal aid services facilitate basic understanding of the law and access to services by the poor so that they can have recourse to lawful means of settling disputes and conflicts. It also enables disadvantaged groups to manoeuvre administrative barriers that prevent them from enjoying their rights. 63% of the population in Swaziland live below the poverty line (SHIES 2011) and are largely found in the rural areas where legal services are limited and there is a low level of awareness on legal rights. Legal aid services need to be relevant to the needs of the poor to assist them to secure their rights in matters involving inheritance, family disputes; land encroachment cattle grabbing, family conflict to mention a few. Matters which if not addressed in a lawful manner could lead to mob violence, conflict and community insecurity.
There is also recognition that legal aid services can also redress the balance of power or equality before the law and offer a first line of protection to those in conflict with the law in police stations to ensure their constitutional rights. The perceived benefits of a national legal aid in Swaziland are: access to justice for indigents who would otherwise not be able to access the right to be heard, the elimination of unnecessary detention; speedy processing of cases; fair and impartial trials; and reduction of prison populations and detentions. It is on this premise that a technical expertise is requested to facilitate the development of a comprehensive National Legal Aid Policy including a regulatory framework which will support the establishment of a Legal Aid System in Swaziland in line with regional and international conventions and protocols and also outline appropriate legislations required to facilitate the implementation of legal aid in Swaziland.
The objective is to facilitate the formulation and draft the national legal aid policy in line with regional and international protocols such as the Lilongwe Declaration on Accessing Legal Aid in Criminal Justice Systems in Africa (2004), Paris Declaration, UN Principles and Guidelines on Legal Aid in Criminal Justice, Human Rights Conventions.

Duties and Responsibilities

  • Conduct desk review of relevant reports, national legal framework and national, regional and international reports on best practices aimed at providing legal aid and promoting access to justice for indigents and vulnerable persons.
  • Conduct in depth consultation with government departments, the Judiciary, non state actors, Swaziland Law Society and other stakeholders on the national policy and legal aid legislation.
  • Re-examine the current state legal aid services provided in relation to skills commensurate to offences; appointment; related costs etc and recommend as appropriate costs effective approaches to state owned Legal Aid service delivery.
  • Define the scope of the Swaziland national legal aid services and persons eligible to access legal aid.
  • Outline the roles of existing and newly proposed institutions and their relationships with each other in providing access to justice including referral mechanisms.
  • Identify and recommend an appropriate model of legal aid service delivery considering private - public partnerships and non state actors.
  • Propose regulatory mechanisms for legal aid service providers (funding, quality of service, regulation, reporting obligations etc) based on transparency and accountability principles.
  • Define criteria and processes for accrediting and monitoring legal aid service providers, non state actors and private institutions.
  • Outline appropriate legislations required to facilitate the implementation of legal aid in Swaziland.
  • Outline modalities for funding national legal aid work in Swaziland.
  • Propose an independent inclusive institutional governing body for the provision of national legal aid services that would facilitate coordination, monitoring and evaluation of the implementation of the national legal aid scheme in Swaziland.
  • Draft the national legal aid policy in line with regional and international protocols such as the Lilongwe Declaration on Accessing Legal Aid in Criminal Justice Systems in Africa (2004), Paris Declaration, UN Principles and Guidelines on Legal Aid in Criminal Justice, Human Rights Conventions etc.
 Deliverables:
  • Stakeholder’s consultation report.
  • A National Legal Aid Policy
Reporting:
  • The Consultant will technically report to a multisectoral reference group to be established with a responsibility of overseeing the development of the national policy and  ensure inclusivity and participation of all stakeholders including the review of the final draft policy document for approval.
Remuneration:
  • The consultancy fees will be based on UN rates and payment contractual terms.

  • Proven analytical, organizational development and inter-personal skills.
  • Research and evaluation skills including ability to synthesize information
  • Excellent oral, and effective presentation and report-writing skills;
  • Express clearly and concisely ideas and concepts in writing and orally

Required Skills and Experience

Education:
  • A minimum of Master’s Degree in the following fields: Law, Public Policy and Development, Political Sciences, Human Rights or a related discipline.
Experience:
  • At least 10 years of relevant professional experience including at least five years experience in policy development and or legal drafting.
  • Experience in drafting policy documents, and carrying out research and studies, analysis especially with developing national legal aid policy framework and legislation.
  • Substantial knowledge and understanding of setting up state and non state owned legal aid system in the SADC region and internationally. (Experience and understanding of the regional context is essential).

Specific Duties and Responsibilities
 Management of the Country Programme Office, efficient management of Country Programme Manager’s schedules. Organization of regular and ad-hoc meetings, preparation of minutes and summaries of actions to be taken; tracking of progress on planned issues and follow-up with focal points :
 Screening of all incoming communications, filter outgoing correspondence for supervisor’s signature, clearance and further action by other staff whenever possible, adherence to appropriate protocol and correspondence guidelines when communicating within UN, Government and external partners, use automated office management system.
 Dealing with procurement functions by assisting in open competitive process through obtaining information, quotations/advertising quotations, supporting RFP and Call for Proposal processes, acting as Procurement Secretary and taking minutes of technical evaluation meetings, preparing technical and financial evaluation reports, preparing the procurement file for LAMRC/LPAC, preparing contracts and maintaining records of all procurement actions, and internal coordination to support processing of payments.
 HR assistance, including preparing Individual Contract and Service Contracts files for LCAP/LAMRC – file maintenance and alerting the CPM timely regards personnel contract expiry and pending performance reviews, leave and absence monitoring and record keeping, ensuring that due process has been followed before submission of documents to the CPM and/or SRO for approval, liaisoning with UNDP HR/UN Women SRO to ensure staff and SC holders benefits and claims are processed timely. Maintenance of a filing system ensuring safekeeping of confidential documents, draft routine correspondence, interoffice circulars, general briefing notes, reports, and minutes of meetings when requested, translation when required. Administration of travel, meetings, appointments and briefings of CPM, including drafting of background notes, with support of Program Specialist.
Qualifications and Experience
 Diploma in Public Administration, Business Administration or related field. A first degree in similar fields will be advantageous. Minimum of 5 years of relevant experience in office administration and/or procurement services. Experience in the usage of computers and office software packages (MS Word, Excel, etc) a requirement, and experience in handling of web-based management systems such as Enterprise Resource Planning (ERP) or ATLAS desirable. Knowledge of the UN a strong advantage. :
 Commitment and understanding of the gender equality and women’s empowerment agenda an advantage.
 Excellent Communication Skills, good command of both spoken and written Kiswahili and English.

UNDP Tanzania seeks to engage an E-Health Data Administrator for the Millennium Villages Project (MVP) in Mbola, Tabora Region. He/she will report directly to the MVP Cluster Health Coordinator on daily sector activities, and to the Team Leader/Operations Manager for general matters. Technically he/she will be supervised by project E-health technical advisors from MDG Centre, South Africa and New York.

Duties and Responsibilities
• In charge of all matters related to E-Health and to maintain disciplinary code and adherence to medical ethics in his conducts and the subordinates, establish and maintain close working relations with local and national Ministry of Health structures responsible for health informatics, ensuring smooth implementation and management of ChildCount Plus program in the cluster. :
• Working with the health team to collaboratively implement the Millennium Global Village-Net (MGV-Net) system in the cluster, assist in the design and implementation of reports using Business Intelligence and Reporting Tool (BIRT) and possibly Pentaho data warehousing tools. Respond to local MVP cluster requests for analytical reports.
• Design and integrate new data collection forms/modules as appropriate using OpenMRS, perform any other duties as may be required by his/her supervisor.
Qualifications and Experience:
• Graduate in medical information system with training in electronic health (Health Informatics), Graduate in general information technology with medical background and electronic health trainings will also be considered, coupled with at least 2-3 years of experience in health information management system field.
• Ability to work with minimum supervision, good interpersonal, organizational and communication skills, team player, demonstrated leadership and facilitation skills, fluency in both English and Kiswahili languages.

Main responsibilities

Under the immediate supervision of Education Programme Specialist and the overall supervision of the Director of the UNESCO
Dar-es-Salaam Cluster Office, the National Programme Officer for Education will:
- Report to the Education Programme Specialist: provide required inputs in the design, planning, and implementation and
monitoring of Education Sector Programmes in five countries under the responsibility of the Dar Es Salaam Cluster Office
(United Republic of Tanzania, Madagascar, Mauritius, Seychelles, Comoros). This includes education sector components
of the Delivering as One process in the United Republic of Tanzania, as well as support to UNESCO activities in the other
Cluster Countries.
- Provide support to the Education Programme Specialist in his/her up-stream, policy engagement functions, as well as
other programme and staff management responsibilities. In addition, he/she will supervise temporary staff and consultants
that might be, or have been engaged on a case by case basis, particularly in the areas of: teacher education; curriculum
development; human rights education; gender and/or inclusive education; and technical & vocational education & training.
The incumbent will be required to apply a results based and gender/human rights based approach to programming and
management.
- Provide key inputs to the process leading to the completion of Education Sector Programming plans for the Cluster, as
well as any other documentation required by the Office, Headquarters and UNESCO Institutions (including proposals,
briefs, reports).
- Keep herself/himself abreast of developments in the education by monitoring and analyzing national, regional and
international trends. Contribute to partnership building and collaboration with other UN agencies and Development
Partners, as well as with Civil Society Organizations. Contribute to positively influencing policy and decision making in the
Education Sector, as required, by: participating in Government, UN, DPG, and NGO forums; playing an evidence based,
advocacy role particularly in relation to the mainstreaming and scaling up of successful UNESCO/UN supported pilots,
gender equity, human rights and inclusive/equitable education; critically reviewing key policy documents; and providing
technical support to Government and NGO partners. When necessary/appropriate, attend with, or represent the
Education Programme Specialist in high level meetings.
- Assist and when requested, stand in for the Education Programme Specialist in his/her strategic oversight, management
supervision and guidance responsibilities, ensuring timely implementation, coherence, complementarity and linkages
within the Education Sector and with the other UNESCO Sectors. Assist in identifying new strategies and courses of action
to accelerate/improve timely implementation and achievement of key results. Provide support in monitoring implementation
particularly in the areas of teacher education, curriculum development, equitable/inclusive education, technical and
vocational education, and provides guidance and technical support to his/her direct supervisees, as well as relevant
government and NGO partners to ensure results are achieved.
- Support the Education Programme Specialist in some administrative functions, including the monitoring of implementation,
overall planning and disbursements of funds under the responsibility of Education Sector in UNESCO, ensuring they are
properly administered, liquidated and utilized in accordance with UNESCO and/or UN Joint Programming rules and
procedures. When requested, supervise temporary staff and/or consultants hired to support the Education Sector In
UNESCO, particularly in the areas of: teachers education, curriculum development, equitable/inclusive education,
technical and vocational education. Conduct field visits in URT and, when required/necessary, other Cluster countries to
observe and monitor/evaluate Education Sector programme implementation, provide appropriate technical support and
timely feedback for process effectiveness.
- Provide timely assistance to the Education Sector/Director when requested, including: planning for /participation
in/facilitation of UNESCO sponsored conferences/Workshops etc; and playing expected role in
establishing/maintaining/strengthening links with UNESCO HQ, Institutes, Regional Offices; other UN agencies,
multilaterals, CSOs.

Profile

- At least a Masters Degree in a relevant field, preferably in education
- At least four years experience in the area of education development/management/monitoring & evaluation; knowledge
and/or experience in the UN system is desirable.
- Good analytical skills, communication skills
- Excellent understanding and use of English and Swahili; some basic French is desirable
- Ability to draft clearly and concisely
- A good understanding of, and experience in applying results and gender/human rights based approach programming and
management
- Good IT skills, particularly with respect to: the Internet, Word Processing, Excel, Power Point
- Proven ability to work in an multicultural environment

Conditions ofemployment

For this post, the annual remuneration in local currency will be based on the local UN salary scale. In addition, UNESCO offers an
attractive benefits package including 30 days annual vacation, pension plan and medical insurance. The initial appointment, which is
for 2 years, includes a probationary period of 12 months, and is renewable, subject to satisfactory service. UNESCO is a nonsmoking
organization.
